Terms of Engagement
Gymboree Group believes that Gymboree has a responsibility to source products in an ethical, legal and responsible manner and Gymboree partners with vendors who share this belief. Every vendor Gymboree works with receives a copy of, and is required to comply with, these Terms of Engagement. While Gymboree understands that there are many different legal and cultural differences in which factories operate throughout the world, these Terms of Engagement set forth, minimum requirements all factories and business partners must meet in order to do business with Gymboree. These Terms of Engagement, as well as our detailed Monitoring Standards in our Vendor Manual, will also serve as the basis for Gymboree to perform ongoing assessment, monitoring and evaluation of a factory's or business partner's employment and legal practices as well as environmental compliance.
Vendors used by Gymboree shall not employ any children (i.e. a person less than 15 years old). Where the law in the country of manufacture defines a "child" to include individuals older than 15, such as when the age for completing compulsory education is more than 15, we will apply that higher age definition. Vendors are encouraged to develop lawful workplace apprenticeship programs whenever possible for the educational benefit of their workers, provided that all participants meet both our minimum age standard of 15 and minimum legal age requirements and follow all applicable laws and regulations concerning juvenile / young workers.
All work shall be voluntary and not performed under threat of penalty, coercion or corporal punishment. Vendors shall not use any prison, debt bonded, compulsory, or indentured labor in the manufacture and finishing of our products.
Gymboree strives to partner with vendors that share our belief that all people are entitled to equal treatment and opportunity in employment.
Vendors shall employ workers on the basis of their ability to do the job, without regard to their gender, age, religion, marital status, race, sexual orientation, disability, disease, nationality, pregnancy, or trade union or political affiliation.
All vendors will ensure that workers who are women receive equal treatment in all aspects of employment. Workers will not be exposed to hazards that may endanger their reproductive health and business partners will not force workers to use contraception.
Freedom of Association and Right to Collective Bargaining
Vendors shall recognize and respect the right of workers to freedom of association and collective bargaining, as well as recognizing the union of the workers and allowing union organizers free access to workers.
Wages, Benefits and Terms of Employment
Vendors shall set wages and overtime pay in compliance with all applicable laws, rules and regulations. Employee compensation, including, without limitation, wages, overtime pay, benefits and paid leave, must meet or exceed minimum legal requirements, industry standards and collective bargaining agreements, if applicable.
Working hours should not exceed sixty (60) hours per week. All overtime must be voluntary, mutually agreed, and compensated at a premium rate. Workers shall be given at least one (1) rest day in any seven (7) day period.
Gymboree requires vendors to treat all workers fairly and with respect and dignity.
Corporal punishment, coercion or public embarrassment may not be used as a disciplinary measure. Vendors' disciplinary procedures must include an escalating series of verbal and written warnings--false reasons may not be used to terminate workers. Vendors must establish an effective grievance mechanism that is easily accessible to all workers.
Harassment or Abuse
Vendors will provide a work environment free of harassment or abuse. Vendors must not engage in or tolerate sexual harassment, indecent or threatening gestures, abusive tone or language or undesired physical contact.
Safe Places to Work
Gymboree maintains a safe, clean, healthy, and productive environment for its workers and expects the same from its vendors. Adequate measures, systems, protections and training must be implemented to prevent harm to workers' health, safety and wellbeing.
Gymboree does not allow sub-contracting. All vendors who outsource subassembly work (e.g.; washing, screen printing, or embroidery) shall supply Gymboree with documentation as required by Gymboree. If subassembly work is done at another location, the Vendor/Factory that was issued the original PO shall be responsible for assuring that the subassembly site is in compliance with Gymboree's Monitoring Standards, including, without limitation, these Terms of Engagement.
Vendors must ensure that the factories they work with only source raw materials which are incorporated into our products from suppliers who comply with all applicable laws, including, without limitation, Gymboree's Monitoring Standards, these Terms of Engagement and the laws regarding slavery and human trafficking.
Concern for the Environment
Vendors shall have current environmental licenses and certificates in place and must comply with all environmental laws, regulations and standards applicable to their industry. Gymboree encourages vendors to reduce waste, use recycled and non-toxic materials whenever possible and to improve energy and water efficiency.
